24 2024 TSMA Mr. Jeff Chen President, Taiwan Sporting Goods Manufacturers Association (TSMA) 01 理事長序 With the opening of national borders and the easing of border restrictions, countries around the world are gradually moving towards the ‘post-pandemic era’ where coexistence with the virus is the norm. The global markets and economies, as seen, are slowly recovering. And the global sports industry is facing new challenges and opportunities. In this context, how should the sports industry in Taiwan transform itself to meet market demands and competitive pressures? According to McKinsey’s report (2022), it is predicted that the activity patterns of fitness consumers have shifted “from physical into virtual” and also formed an irreversible behavior trend. Digital technology has increased the fitness options to break free from time and space constraints, providing flexibility and ranges of choices through virtual forms such as networked fitness equipment, online live classes, fitness apps, and so on. At a short period of time, this development quickly reshapes the fitness industry’s landscape. Fitness activities are no longer divided into “traditional gyms” or “home gyms,” as physical fitness facilities will undergo significant integration with digital technology, evolving into a “hybrid model of the fitness industry,” becoming the new norm in the fitness industry. Technology significantly contributes to the transformation in the fitness industry, especially during the pandemic. Emerging models such as online training, home gyms, and virtual workouts have gained widespread popularity, indicating consumer demand for efficiency, immediacy, flexibility, and diversity. The fitness industry in Taiwan should catch up in this trend and enhance collaboration with the technology sector to develop more fitness technology products and services that align with market demands. This includes smart wearable devices, sports data analysis, personalized training programs, and more, to increase the added value and competitiveness

Sports technology is a cross-fields industry that encompasses knowledge and technology from various professions such as medicine, biology, electronics, and information technology. Taiwan’s fitness industry should leverage the advantages of its domestic IT industry, actively engage in international innovation collaborations, learn from advanced international researches and applications in sports technology, and simultaneously promote Taiwan’s achievements in sports technology to the global market. Furthermore, this shall upgrade market values and enhance international recognition as well as influences of the fitness industry in Taiwan. Facing the global aging population, the health of the elderly has already become an urgent issue for many governments. Moving with the advances of healthcare and technology, human lifespans are prolonging. Evidently, keeping muscle mass is an essential aspect to maintain physical functions in daily life. Designing exercise programs for the elderly can incorporate functional trainings to improve basic balance, coordination, muscle strength, and endurance, thus enhancing the quality of life for the elderly. In addition, modern people recognize how important to keep their quality of life and well-being, enjoy leisure, travel, and more, all of which underscore the significant business opportunities within the sports and health industry. “Made in Taiwan” is a brand with a rich history and cultural heritage, representing the hard work, innovation, quality, and service of the Taiwanese people. The sports industry in Taiwan should fully leverage the advantages of “Made in Taiwan” and emphasize the unique characteristics and differentiation of Taiwanese sports products and services. This could include a focus on user-friendly design, adherence to environmental standards, adaptability to diverse cultures, and so on. This will help better the brand image and trustworthiness of the Taiwanese sports industry, allowing the “Made by Taiwan” brand to shine brightly once again. At the same time, TSMA upholds the primary mission of service and industry promotion, advocating an all-people sporting culture. We strive to assist businesses in gradually transitioning to digital operations and upgrading their business models while facing a new norm of life during the pandemic. We are continuing to provide recommendations to the government, proposing policies that can enhance nationwide sports participation and promote proper physical activities for the elderly. This includes expanding the domestic market for sports equipment and tailoring initiatives to cater to various user demographics. Leveraging the characteristics of digital technology, we make efforts to assist the government in driving policies, cross-integrating sports industry platforms, aggregating vast amounts of cloud data, expanding business opportunities in exports, and promoting Taiwan’s image as a manufacturer of quality goods (MIT).

Thus, it is important to reduce the number of unhealthy years. The easiest and best way to accomplish this is for everyone to adopt an exercise routine that suits them from the time of their youth to retirement. Everyone can develop a good exercise regime by choosing appropriate sporting goods and equipment. The integration of technology in the sports industry is reshaping the landscape of intelligent educational and recreational experiences As COVID-19 restrictions are lifted worldwide, the sporting goods industry is experiencing significant growth driven by the maturity of digital technology applications and the development of sports leagues. According to a Statista survey, the total global revenue of the sporting good market is projected to reach $160.9 billion in 2023, with a projected compound annual growth rate (CAGR) of 6.02% from 2023 to 2028. Over the past year, the global sporting goods industry’s revenue has been affected by inventory adjustments at the retail level. However, the enthusiasm for sports remains unabated, and with major events such as the 2023 Chengdu WUG, the 2024 Hangzhou Asian Games, and the Paris Olympics on the horizon, channel inventories are gradually being depleted. The sports goods industry is expected to gradually recover to pre-pandemic growth levels in the fourth quarter of 2023.

The pandemic accelerated industry transformation with the introduction of new technologies and facility types, leading the sports goods industry towards diversification and targeting specific demographics. The establishment of independent clubs and studios has also fragmented the market for chain fitness clubs, emphasizing “depth” or “specialization”. This trend has propelled the growth of smaller-scale fitness models and ushered in a new wave of “wellness industry” trends such as indoor fat reduction and preventive medicine, expanding opportunities within the industry. Ministry of Finance statistics indicate that the number of sports-related businesses has steadily increased from 2,511 in 2017 to 5,482 in 2022. Notably, businesses in the “Other Sports Services” category have more than doubled, indicating that more information and technology service providers are entering the fitness sector, creating new lifestyle experiences. Moreover, the ongoing focus on industry digitization is a key driver of development. According to research by Spherical Insights & Consulting, the global sports technology market was valued at $201.3 billion in 2022 and is projected to reach $763.9 billion by 2032, with a CAGR of 14.27%. The integration of technology sports events and the continuous innovation of sports-tech products and platforms are key drivers of growth in the global sports technology market. Both online and offline sports-related activities are witnessing significant investments in areas such as data analytics for sports, sports performance monitoring, virtual reality applications, and sports wearables, all of which are contributing to the expansion of the global sports technology market. For example, several national sports centers have already integrated smart technology, establishing facilities such as intelligent badminton courts, futuristic baseball halls, solar-powered sports mats, VRBOX virtual shooting ranges, immersive smart spin bikes, and indoor golf simulators, among various other technological equipment. Such innovations are providing the public with fresh and exciting sports experiences. Sports goods industry players are continually pushing to integrate IoT with key technologies such as

Taiwan possesses a well-established sports industry supply chain, and many companies serve as contract manufacturers for internationally renowned sports technology firms. These factors make Taiwan an ideal hub for development at the intersection between sports and technology. In recent years, the Industrial Development Administration (IDA) of the Ministry of Economic Affairs (MOEA) has been actively promoting various initiatives to encourage the development of the “Sports X Technology” industry. They are assisting businesses in implementing smart manufacturing and digital transformation solutions, enhancing their capacity to support sports science, and fostering capabilities that align with global standards and trends. Furthermore, in response to the requirements of international brand manufacturers and the initiation of the Carbon Border Adjustment Mechanism (CBAM), carbon reduction has become a critical issue for all export industries. To assist businesses in meeting the growing demands of international net-zero emissions trends and supply chain requirements, the IDA has established the industrial energy saving and carbon reduction information website for the promotion of carbon reduction initiatives. Through collaborative efforts between the government and industry, the goal is to create a new era of intel l igent enter tainment and leisure by 2030 - “Sports Everywhere”. Its publication, the TSMA Yearbook, has a history of over 40 years. This longevity is mirrored in the collaboration between TAITRA and TSMA in organizing TaiSPO, a major trade show for the sporting goods industry, for nearly 50 years. Together, these organizations have strived to advance Taiwan's sporting goods industry. I am honored to be invited to write the prologue for the TSMA Yearbook once again. In recent years, the global sports goods market has experienced a slight decline due to rising inflation and economic slowdown. However, with the increasing popularity of leisure and health activities, the growing population of female athletes, and the upcoming major international sports events such as the Olympics in 2024, market demand is expected to rebound. According to the research firm Research Reports World, the compound annual growth rate of the global sporting goods industry is projected to reach 6.4% from 2022 to 2027. To help Taiwanese sports goods suppliers seize these business opportunities, the 49th edition of TaiSPO will be held from March 6th to 9th in 2024. The exhibition will be showcased under three major themes: "Vibrant Health Community," "Outdoor Lifestyle Enjoyment," and "New Dimensions in Sports Competition." It is expected to attract over 1,200 professional buyers from 61 countries, demonstrating the continuous improvement and competitiveness of Taiwan's sports goods industry. (Mason) Zwiebler President & CEO, The World Federation of the Sporting Goods Industry wfsgi.org ‘Unite and support the global sporting goods industry to ensure a healthier, more active planet for all’ That is the purpose of the World Federation of the Sporting Goods Industry (WFSGI) and it a great honour to address TSMA members for the first time as the Interim CEO. Having dedicated five and a half years to WFSGI, it’s a privilege to now lead the WFSGI team, and to drive our collective purpose forward on behalf of our members. WFSGI proudly represents over 70% of the global sporting industry, including TSMA. With a powerful platform and a passionate industry, we have a responsibility to get behind the most pressing issues for our members and drive positive change. The past few months have been dedicated to working with the team and our Board on finalising our new Strategic Plan, our roadmap to be unveiled to member companies at our General Assembly at ISPO Munich in November 2023. We will be focussing on addressing the key global issues for our members, and actively collaborating to find solutions.

To increase levels of physical activity via the implementation of our MOU with the World Health Organisation. 2. To partner to support our members reduce their impact on the planet. 3. To further strengthen the industry voice in the Olympic movement and with priority International Sport Federations. 4. To build on our work to facilitate and promote free and fair trade. As a former professional-athlete, I’m proud to lead an organisation that prioritises physical activity. The benefits are clear, ranging from preventing diseases to enhancing well-being and mental health. However, the current global statistics are alarming, with over a quarter of adults insufficiently active and the next generation marking the lowest activity levels in history. And this is not just a health issue. It’s business. Without action, these inactivity statistics will impact the future growth of our industry. Together, we will build on our historic MOU with the World Health Organization to get the world moving more. We look forward to continuing to work with TSMA as we move into 2024 and begin implementing our new Strategic Plan. We thank TSMA for their ongoing support and partnership as a valued WFSGI member. 34 2024 TSMA 2. SFIA State of the American Industry After a record-breaking revenue industry sales growth of 15.8% in 2021, it was inevitable that performance could not be matched in 2022. But the 4.3% growth this year in the sales of sports, fitness, outdoor and active athletic apparel, footwear, and equipment still represents the second largest percentage increase our industry has recorded since 2010. That is good news, driven clearly by the most positive takeaway of SFIA’s sports participation analysis: the number of physically active Americans grew for the fifth consecutive year, both at the total and CORE measurement levels, with 77.6% of all Americans reporting taking part in one of the 124 sports and fitness activities that SFIA monitors throughout the year. This is a remarkable fact given the absolute roller coaster/disruption of routines, habits, and lifestyles our country has experienced since 2018. Fundamentally, this trend reflects a demonstrable uptick in the awareness Americans have today for the physical, mental, and social benefits of a physical activity. At the same time, supply chain hangover, rapidly rising inflation, and the looming threat of recession made for a complicated operational year for many companies Mr. Tom Cove President & CEO, Sports & Fitness Industry Association (SFIA)

35 Taiwan Sporting Goods Manufacturers Association and individuals. Three years of disruption, uncertainty, and inability to forecast will take its toll. While cumulative single numbers are instructive, the best insights come from analysis of the key factors influencing our business. Inflation had an overriding impact on our industry as well as the national economy, with rising costs of inputs throughout the supply chain increasing prices passed on to consumers. Too, consumers faced dramatic price increases in basic staples like gas and groceries. If not abated, this dynamic will adversely influence our consumers’ inclination to purchase our products, which generally are discretionary. Inventory was another huge story in 2022 as the pendulum shifted from supply chain shortages in 2021 to advanced orders, full production, and smoother deliveries in 2022. Inventory levels grew across the industry, with 67% of our responding companies reporting higher inventories in 2022. Individual company profitability trends show a mixed bag. 55.2% of companies said they increased profitability last year – second best showing since 2015 – while 28.4% experienced decreased profitability. The “decreased profitability” figure is higher than pre-pandemic levels. Last year was a difficult year to categorize. Sports and fitness companies continued to meet strong demand for their products and collectively realized healthy annual growth. At the same time, many SFIA member companies reflected high concern around uncertainties in the marketplace that lasted much longer than anyone anticipated at the beginning of 2022.

Schaefer Legal Counsel The World Federation of the Sporting Goods Industry IMPORTANT TO KNOW: The New Forthcoming EU General Product Safety Regulation (“GPSR”) Will Raise the Bar to be in bold Compliance with EU Safety Standards Introduction: Taiwanese sporting goods manufacturers and exporters in particular TSMA member companies are very well known for their strive for excellence and high-quality products also in Europe in particular in the fitness equipment sector. The Taiwan S-Team Elite League initiative clearly demonstrates this. High-quality goes hand-in-hand with product safety and warranting product safety is an element which clearly differentiates internationally successful commercial operators from others trying to make a quick buck by attempting to sell products with inferior quality, which very frequently also are raising safety concerns. If you are engaged in business with Europe, you certainly do not want that your products are listed as being unsafe in the Safety Gate online portal (, the EU’s rapid alert system for dangerous nonfood products, like just one example out of one of many shown here: In this specific case the EU authorities ordered the withdrawal of the unsafe product from the market and recall measures to be taken by the European distributor to have such returned by the end-users if al-

37 Taiwan Sporting Goods Manufacturers Association ready sold. These are embarrassing, brand damaging and costly steps to be taken, which can be avoided by producing safe products only. My following 2024 contribution for TSMA is intended to answer some of the questions TSMA members may have about the GPSR, what it is by its very nature, what products will it cover, for whom and the supply chain it will have an impact and even more important how you as a business can prepare. What is the EU General Product Safety Regulation (“GPSR”), and why does it matter? The EU Commission defines the forthcoming GPSR (General Product Safety Regulation) as “a new key instrument in the EU product safety legal framework, replacing from December 13, 2024 onward the current General Product Safety Directive … It modernizes the general product safety framework and addresses the new challenges posed to product safety by the digitalization of our economies.” After nearly three years of intensive work on this new legislative tool, the GPSR was published in the EU’s Official Journal in May of this year. 38 2024 TSMA And in contrast to an EU Directive, a Regulation leaves no room for divergence by national legislators. December 2024 may seem a fairly long way off right now but given the very substantial impact the GPSR will have on the sporting goods sector – throughout the whole supply chain – Taiwanese manufacturers and exporters are well advised to get ready for the multiple new tasks and challenges the GPSR regulation will bring to the table. It consists of 50 articles, but it is not the sheer volume of the GPSR that counts, but its far-reaching contents. The following article is by no means meant to be exhaustive, but it highlights certain focal points of the new forthcoming Regulation and some of the major practical consequences it will have for sports brands, manufacturers, importers, distributors, and retailers. What Products are covered by the EU's GPSR? A prime objective of the new GPSR Regulation is to prevent European consumers from being exposed to health and safety risks when using consumer products under reasonably foreseeable conditions. So all consumer products on the EU markets are affected. However, products that are exclusively designed for professional use, but which have subsequently migrated to the consumer market are also covered by the GPSR. A practical example would be safety footwear or fitness equipment purchased by professional gyms, which will then be used by consumers for exercise and training purposes. Even secondhand products or products that have been repaired, reconditioned, or recycled and which reenter the supply chain in the course of commercial activity fall within the scope of the GPSR. This is unless a clear message is sent to the targeted consumer that such a product has been reworked. Who is affected by the EU's GPSR? The GPSR makes it clear that economic operators in the supply chain should have proportionate obligations in relation to their respective roles. This means that spheres and scopes of responsibilities and obligations need to be defined. A retailer, for instance, may not be required to examine whether certain product information provided by a manufacturer or importer is correct or not; while an EU distributor at wholesale level may well have such an obligation. Unsurprisingly, the most comprehensive obligations and corresponding liabilities are imposed on the manufacturers of consumer products. Article 9 of the contains 13 paragraphs alone outlining (in detail) the scope of such obligations. These range

39 Taiwan Sporting Goods Manufacturers Association from: • carrying out an internal risk analysis prior to placing the product on the market; • specific instruction and identification requirements; • constant product monitoring duties; • up to the obligation to take, in a timely fashion, corrective measures such as a product recall. The Commission provides a communication channel through its Safety Business Gateway and the publication of any incidents, which is fully accessible to consumers on its Safety Gate Portal (see https://ec.europa.eu/safety-gate-alerts/screen/webReport ). Article 10 of the GPSR defines the role, tasks and duties of authorized representatives, while Article 11 creates a set of extended obligations for importers. In addition, Article 12 stipulates the obligations of distributors such as retailers, who are e.g., required to immediately inform the manufacturer or importer of a certain product if they have reason to believe that it constitutes a dangerous health risk to consumers. All economic operators in the supply chain must fully cooperate with EU market surveillance authorities in the event of product safety-related incidents. In this context, it will become imperative to be well-documented. How does the EU's new GPSR define “health” and “safety,” and why does this matter? The EU legislators have adopted the very broad WHO definition of health, which is defined as “a state of complete physical, mental and social well-being and not merely the absence of disease or infirmity.” This terminology triggers a much broader liability of economic operators than is the case right now. When it comes to the assessment of whether a certain product is “safe” or not, the EU GPSR regulation again interprets “safety” in the broadest possible manner. What is emphasized is that all relevant aspects of a product need to be taken into consideration, which means: • the materials it is composed of; • its product features; • how the respective product is presented, and for which kind of consumers it is primarily geared for (in particular if it is intended to be used by children, older or disabled persons).
